Many people who live in small apartments are thinking about maximizing space by closing the balcony that benefits their building. But is this a good idea? Even if the change itself seems easy to make, it is a long road full of permits, travel, and time-consuming changes.

The most important thing to remember is that, in many cases, closing the balcony is done illegally, without the people in question obtaining the necessary permits. Thus, closing the balcony not only interferes with the appearance of the building and can seriously affect its structure, but can also bring you a substantial fine, as long as the rules are not followed.

In this sense, Law no. 149/2020, is an important point in the process initiated by you. This stipulates that those who have a house on the ground floor and want to close the balcony or the loggia, only need the consent of the owners' association, without the need for the consent of each neighbor. However, those who wish to use this law must present serious reasons before proceeding with the procedure. The reasons presented must be related to the security of your home, the reduction of noise from outside, odors from nearby (if applicable).

Documents required to close the balcony
Law no. 193/2019 for the amendment and completion of Law no. 50/1001, provides that in order to close the balcony, you need a building permit. To issue the document you need the following documents:
• Architectural memorandum - represents a project extract, made for the design, extension or modification of a construction. It includes many chapters, which include general details about the building, the description of the proposed works, the characteristics of the area subject to change, the fulfillment of quality requirements, etc .;

• Survey - this document contains information related to the operation of measurement, drawing and scale representation of new elements to be built;

• The proposal to close the balcony, for the works related to them;

• The approval of the initial designer or, as the case may be, the technical expertise for the space owned by the applicant, regardless of the function that the balcony will occupy.

An enclosed balcony automatically means a different building project than originally thought. That is why an authorization is needed. Here are the steps you need to check to get it:
1. Procurement of the construction permit, through a request submitted to the Office of Notices and Single Agreement within the City Hall within the radius of which the apartment is located;
2. Procurement of the written agreement of the owners' association;
3. Obtaining the technical project with the help of a design office;
4. Submission of the project to obtain the building permit. The project will include the construction permit, the technical project, the architectural memorandum and the survey.

Usually, the building permit obtained has a shelf life of between one month and six months or even longer, depending on the town hall.
