Land book extract. How many types is it and how do you get it?

All the details and information regarding a building or land can be found in the land book. In other words, the land book keeps a technical, economic and legal record of all buildings and land. It is an official and public document that includes the name of the owner (natural or legal person) and aspects related to the building or land he owns (place, neighborhoods, area, etc.).

All territorial administrative units have a land register. Because it is a public document, any person can request information about a building or land from the Offices of Cadastre and Real Estate Advertising within the scope of each territorial administrative unit.

Depending on the purpose for which they are issued, there are several forms of land book extract:
1. For information
This type of statement is for information purposes only and cannot be used to conclude a real estate transaction. Because it has no legal value, it can be requested by anyone. The land book extract for information contains current data regarding:
• Real estate: surface, number of rooms, outbuildings or common parts quotas (if applicable), land quotas, cadastral number, etc.
• Owner: general data, the act on the basis of which the property was registered, the relations between the owners (if there are several), etc.
• Legal situation: data regarding possible lawsuits, mortgages, promises of sale, purchase.

2. The land book extract in extenso
It includes all the information and details found in the land book extract for information, but to this is added the history of the building or land from construction to the present, even information about the former owners.
This act also has no legal value, but only an informative character, but it can be used for a credit file or for the use of real estate or land as a bank guarantee. It can also be used for issuing personal documents, in establishing the succession or in other situations established by law.

3. Extract for authentication
It is the only one of the three types that underlies a real estate transaction and can only be requested by an authorized person. The notary public may request the extract on behalf of the holder, and the request is made through an application that has the signature and the unique seal of the notary.
If a building or land has been put up for sale and is purchased by a person, the notary requests the documents, and the land book in question is blocked until the completion of the transaction. In order to avoid possible fraud, until the end of the transaction no other person can have access to information about the property or land,
This extract is valid for 10 days from the moment of release and is the only document that certifies the change of owner.

How to obtain the land book extract and how much does it cost?
The land book extract for information and the one in extenso is issued following a request made either by a natural person or by a legal person, public or private, who wants to know all the information about a building or a land, and the authentication only by an authorized person.

The fees charged for these are: 20 lei / copy for the land book extract for information, 5 lei / page for the land book extract in extenso and 40 lei / copy for the land book extract for authentication. An emergency fee is also applied, which can vary from 100 to 200 lei.

The time for issuing any type of extract in the normal regime is two working days, in addition to the day on which the application is submitted. The request can be made directly at the Office of Cadastre and Real Estate Advertising within the territorial administrative unit of which you are part or online, on the website www.ancpi.ro.
